1. Acceptance of Terms

Welcome to Stream Alert LLC. By accessing or using our service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service.

Stream Alert LLC provides a donation aggregation and notification platform for content creators. We reserve the right to modify these Terms at any time. Continued use of the service after changes constitutes acceptance of the modified Terms.

2. Eligibility

You must meet the following requirements to use our service:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Have an active Twitch or YouTube channel (required for registration)

By using our service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

3.1 Account Creation

To use Stream Alert LLC, you must create an account by providing:

• Full name
• Username
• Email address
• Password
• Verification of your Twitch or YouTube channel

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Ensuring your account information is accurate and up-to-date

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any other reason at our sole discretion.

4. Service Description

Stream Alert LLC provides the following services:

4.1 Donation Tracking

• Monitor Gmail inbox for donation notifications from Cash App, Venmo, and other payment platforms
• Parse donation information (donor name, amount, message)
• Store donation records in your account dashboard
• Provide analytics and reporting on donation history

4.2 Real-time Alerts

• Send donation alerts to connected Streamlabs account
• Send donation alerts to connected StreamElements account
• Real-time WebSocket notifications for instant updates
• Multi-platform alert delivery with status tracking

4.3 Platform Integrations

• Google OAuth for Gmail access
• Streamlabs OAuth integration
• StreamElements API integration
• Twitch and YouTube verification

5. Subscription and Billing

5.1 Subscription Plans

Stream Alert LLC offers subscription-based access to premium features. By subscribing, you agree to pay the applicable fees.

• Monthly subscription plan
• Annual subscription plan (with discount)
• 7-day free trial (first-time subscribers only)

5.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for all fees.

5.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date. You will be charged the then-current subscription rate.

5.4 Cancellation

You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellations take effect at the end of the current billing period. No refunds are provided for partial billing periods.

5.5 Free Trial

First-time subscribers receive a 7-day free trial. You will not be charged during the trial period. If you do not cancel before the trial ends, your payment method will be charged for the subscription.

5.6 No Refund Policy

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS UNDER ANY CIRCUMSTANCES.

By subscribing to Stream Alert LLC, you acknowledge and agree that:

• No refunds for usage: Once you begin using the service, you are not eligible for a refund, even if you use the service for only a brief period within your billing cycle.
• No refunds for technical issues: If you experience technical difficulties, service disruptions, bugs, or any other issues with the platform, you are not entitled to a refund. We encourage you to contact our support team to resolve any issues.
• No refunds for third-party service failures: We are not responsible for failures, outages, or issues with third-party integrations (Gmail, Streamlabs, StreamElements, Twitch, YouTube, Stripe) and will not issue refunds for such occurrences.
• No refunds for dissatisfaction: If you are dissatisfied with the service for any reason, you will not receive a refund. We recommend using the 7-day free trial to evaluate the service before committing to a paid subscription.
• No refunds for cancelled subscriptions: If you cancel your subscription, you will retain access until the end of the current billing period, but no refund will be provided for any unused portion of the subscription.
• No refunds for account termination: If your account is terminated by us for violation of these Terms or any other reason, you will not receive a refund for any remaining subscription period.
• No refunds for disputes or chargebacks: Initiating a chargeback or payment dispute with your payment provider will result in immediate account termination without refund.

Support for Issues: While we do not offer refunds, we are committed to helping you resolve any technical issues. Please contact us at [email protected] if you encounter problems with the service. We will make reasonable efforts to address your concerns and fix any bugs or technical difficulties.

Trial Period: We strongly encourage you to thoroughly test the service during the 7-day free trial period before purchasing a paid subscription. The trial period is provided specifically to allow you to evaluate whether the service meets your needs.

BY SUBSCRIBING AFTER THE TRIAL PERIOD, YOU EXPRESSLY ACKNOWLEDGE AND AGREE TO THIS NO REFUND POLICY.

6. User Conduct and Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Violate any third-party rights, including intellectual property rights
• Transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or other user accounts
• Interfere with or disrupt the service or servers
• Use automated scripts, bots, or scrapers without permission
• Reverse engineer, decompile, or disassemble any part of the service
• Create fake donations or manipulate donation data
• Share your account credentials with others
• Use the service to send spam or unsolicited communications
• Abuse our API rate limits or attempt to bypass security measures

7. Third-Party Services and OAuth

7.1 Third-Party Integrations

Our service integrates with third-party platforms (Gmail, Streamlabs, StreamElements, Twitch, YouTube). Your use of these services is subject to their respective terms of service and privacy policies.

7.2 OAuth Authorization

By connecting third-party services, you grant us permission to access your account information as specified in the OAuth consent screen. You can revoke this access at any time through your account settings or the third-party platform.

7.3 Gmail API Access

By connecting Gmail, you authorize us to:

• Read emails from specific payment service senders only (Cash App, Venmo, StreamAlert)
• Monitor your inbox for new donation notifications using Gmail Watch API
• Parse email content to extract donation information

We comply with the Google API Services User Data Policy, including Limited Use requirements. We do not access, store, or process emails outside of donation detection.

8. Intellectual Property

8.1 Our Intellectual Property

All content, features, and functionality of the service (including but not limited to text, graphics, logos, icons, images, audio clips, software, and source code) are the exclusive property of Stream Alert LLC and are protected by copyright, trademark, and other intellectual property laws.

8.2 Your Content

You retain ownership of any content you submit through the service (donation messages, profile information, etc.). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display this content solely for the purpose of providing the service.

8.3 Trademarks

"Stream Alert LLC" and our logos are trademarks. You may not use our trademarks without our prior written permission. All third-party trademarks mentioned are the property of their respective owners.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of donation data
• Warranties that all donation alerts will be successfully delivered

We do not guarantee that the service will meet your requirements or that defects will be corrected. Use of the service is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAM ALERT LLC SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Missed donations or failed alert deliveries
• Damages resulting from third-party service outages (Gmail, Streamlabs, StreamElements)
• Unauthorized access to your account resulting from your failure to secure credentials
• Any damages exceeding the amount paid by you for the service in the past 12 months

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Stream Alert LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the service
• Your breach of any representation or warranty

12. Data and Privacy

Your use of the service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Service Availability and Modifications

13.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

13.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the service at any time without notice. We are not liable for any modification, suspension, or discontinuation.

13.3 API Rate Limits

We may implement rate limits on API usage to ensure fair use and system stability. Abuse of rate limits may result in account suspension.

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us or through account settings. Upon termination, you will lose access to all data and features.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Prolonged inactivity
• At our sole discretion for any reason

14.3 Effect of Termination

Upon termination, all rights granted to you will cease, and you must stop using the service. Sections of these Terms that by their nature should survive termination (including warranty disclaimers, limitation of liability, and dispute resolution) will survive.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

15.2 Arbitration

Any dispute arising out of or relating to these Terms or the service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. You waive the right to participate in class action lawsuits.

15.3 Informal Resolution

Before initiating arbitration, you agree to contact us to seek informal resolution of the dispute.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stream Alert LLC regarding the service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

16.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, or internet/telecommunications failures.
